# How to Start a Forex Brokerage in the UK: FCA Authorisation, Capital and Technology (2026 Guide)

By Broker White Label Solutions Team · Published 2 November 2026 · 11 min read

**Quick answer**

To start a forex or CFD brokerage in the UK you need authorisation from the Financial Conduct Authority (FCA) with the right Part 4A permissions, such as dealing as principal or agent and holding client money. Under the UK investment firm prudential regime (IFPR), the permanent minimum capital is £750,000 for firms that deal on their own account, £150,000 for firms that hold client money but do not, and £75,000 for others. You also need approved senior managers, a compliance function, CFD retail protections (leverage limits, 50% margin close-out, negative balance protection) and systems that show good customer outcomes under the Consumer Duty.

**Key takeaways**

- Every UK forex or CFD broker needs FCA authorisation; there is no lighter offshore-style route.
- Your permissions decide your capital: £750k if you deal on own account (market maker), £150k if you hold client money, £75k otherwise.
- Retail CFD rules cap leverage at 30:1 on major currency pairs, and crypto derivatives cannot be sold to retail clients.
- The FCA must decide a complete application within 6 months (12 months if incomplete).
- Your CRM, risk and reporting systems must support appropriateness tests, client money reconciliation and transaction reporting.

London is one of the world's biggest centres for currency trading, and an FCA licence is one of the most respected in the industry. It is also one of the most demanding. This guide explains what it takes to start a forex or CFD brokerage in the United Kingdom in 2026, from permissions and capital to the technology the FCA will expect you to run.

## Who regulates forex brokers in the UK?

The **Financial Conduct Authority (FCA)** authorises and supervises firms that offer rolling spot forex and CFDs. Firms apply for **Part 4A permission** under the Financial Services and Markets Act 2000. Once authorised, the firm is listed on the FCA register, which clients and partners use to check you.

Unlike many other countries, there is no separate "forex licence". Your authorisation is defined by the activities you ask permission for. The most common for brokers are:

- **Dealing in investments as principal** — you are the counterparty to client trades (market maker or B-book).
- **Dealing in investments as agent** and **arranging deals** — you pass orders to liquidity providers (agency or A-book models).
- **Holding client money** — needed if client deposits sit in your accounts, which brings the FCA's CASS client money rules.

## How much capital does a UK broker need?

Under the UK investment firm prudential regime (IFPR), set out in the FCA's MIFIDPRU rules, each firm has a **permanent minimum requirement**. Your own funds must also cover your fixed overheads and "K-factor" requirements, so the real figure is usually higher than the minimum.

| Type of firm | Permanent minimum requirement | Typical broker model |
| --- | --- | --- |
| Deals on its own account | **£750,000** | Market maker or hybrid broker |
| Holds client money, does not deal on own account | **£150,000** | Agency (STP) broker holding client funds |
| Other investment firms | **£75,000** | Arrangers and introducers that do not hold client money |

On top of capital, you need liquid assets, an internal capital and risk assessment (ICARA) and a wind-down plan.

## Retail CFD rules you must build in

Since August 2019, the FCA's permanent CFD rules protect retail clients. Your trading platform and CRM must enforce them:

| Rule | What it means |
| --- | --- |
| Leverage limits | 30:1 for major currency pairs, 20:1 for other pairs, gold and major indices, 10:1 for other commodities and indices, 5:1 for shares |
| Margin close-out | Positions are closed when equity falls to 50% of required margin |
| Negative balance protection | Retail clients cannot lose more than the money in their account |
| No inducements | No bonuses or trading incentives to attract retail clients |
| Risk warnings | A standard warning with the percentage of your retail accounts that lose money |
| Crypto derivatives | Cannot be sold to retail clients in the UK (since January 2021) |

## People and governance

The Senior Managers and Certification Regime (SM&CR) applies. You need approved senior managers (such as the CEO, a compliance oversight function and an MLRO), clear responsibilities and staff who are certified as fit and proper. The FCA expects real substance in the UK: decision-makers, compliance and risk staff who actually run the business.

The **Consumer Duty**, in force since 31 July 2023, also requires you to show good outcomes for retail clients. That means fair value, clear communications, products that suit the target market and good support, backed by data you can report to your board.

## Step-by-step: how to start a UK brokerage

1. **Define your business model.** Decide your execution model, client types (retail or professional) and products.
2. **Map your permissions.** Choose the Part 4A permissions that match your model, which sets your capital.
3. **Build the team.** Appoint senior managers, compliance, risk and finance staff in the UK.
4. **Prepare the application.** Business plan, financial projections, ICARA, policies and a detailed description of your systems and outsourcing.
5. **Choose technology and providers.** Trading platform, liquidity, CRM, payments and reporting, with due diligence on each supplier.
6. **Submit and answer questions.** The FCA must decide a complete application within 6 months, or 12 months if it is incomplete. Expect detailed questions.
7. **Launch and report.** Go live with client money reconciliation, transaction reporting and Consumer Duty monitoring.

## The technology an FCA-authorised broker needs

| Requirement | What your systems must do |
| --- | --- |
| Appropriateness and KYC | Run appropriateness questions, ID checks and record every decision in the [CRM](https://www.brokerwhitelabelsolution.com/crm) |
| Client categorisation | Separate retail and professional clients and apply the right leverage groups |
| Risk management | Monitor exposure, margin levels and negative balances in real time with [risk tools](https://www.brokerwhitelabelsolution.com/risk-management) |
| Client money (CASS) | Daily reconciliation between trading balances, the CRM and bank accounts through your [back office](https://www.brokerwhitelabelsolution.com/back-office) |
| Regulatory reporting | Transaction and derivatives reporting, plus management information for the board through [reporting and BI](https://www.brokerwhitelabelsolution.com/reporting-bi) |
| Operational resilience | Mapped important business services, impact tolerances and tested recovery plans |

Payments in the UK are mostly Faster Payments, Open Banking (pay-by-bank) and cards with strong customer authentication, all linked to the CRM so deposits credit automatically.

## Alternatives to a full FCA licence

A full FCA authorisation is not the right first step for everyone:

- **Appointed representative.** Some introducers work under an authorised principal firm's permissions rather than applying themselves.
- **A licence elsewhere.** Some groups launch with a licence in another country first. Note that such an entity generally cannot market to UK retail clients without UK authorisation.
- **Prop trading firm.** Prop firms usually sell evaluations rather than broker services, but take legal advice on how your model is treated.
